Comparative valuation of different policy interventions often requires interpersonal comparability of benefit. In the field of health economics, the metric commonly used for such comparison, quality adjusted life years (QALYs) gained, has been criticized for failing to respect the equality of all persons’ intrinsic worth, including particularly those with disabilities. A methodology is proposed that interprets ‘full quality of life’ as the best health prospect that is achievable for the particular individual within the relevant budget constraint. This calibration is challenging (...) both conceptually and operationally as it shifts dramatically when technology or budget developments alter what can be achieved for incapacitated individuals. The proposal nevertheless ensures that the maximal achievable satisfaction of one person’s preferences can carry no more intrinsic value than that of another. This approach, which can be applied to other domains of social valuation, thus prevents implicit discrimination against the elderly and those with irremediable incapacities. (shrink)

An essay on the compatibility of Jewish and Muslim aspirations for the Land that argues that a vision of peaceful coexistence to provide a spur to the settling of grievances, but that this vision must respect the deeply felt aspirations of both communities, including in particular those underpinned by religious lore. Existing formulations of the aims of each community are blatantly inconsistent; it is time to attempt to characterise the just and religiously authentic goals of each community in ways that (...) are compatible. I argue that there religious and personal dimensions of the conflict that have been displaced by less deep-seated political goals, but which can be addressed more readily. Even where willingness-to-pay as a measure of welfare impact is adjusted for diminishing marginal utility, welfare economics is shown to favour policies that add to the life expectancy or that enhance the quality of life of persons who are already better-off. I propose an alternative, Equal Respect methodology, under an axiomatic claim that at the point of decision the prospective life years of all individuals are of equal intrinsic social value. This justifies equal valuation of risk mitigation across all persons; (...) similarly, all appraised impacts should be scaled to accord equal respect to difficult but no-less-valuable lives. In 1947 Donald Cary Williams claimed in The Ground of Induction to have solved the Humean problem of induction, by means of an adaptation of reasoning first advanced by Bernoulli in 1713. Later on David Stove defended and improved upon Williams’ argument in The Rational- ity of Induction (1986). We call this proposed solution of induction the ‘Williams-Stove sampling thesis’. There has been no lack of objections raised to the sampling thesis, and it has not been widely accepted. In (...) our opinion, though, none of these objections has the slightest force, and, moreover, the sampling thesis is undoubtedly true. What we will argue in this paper is that one particular objection that has been raised on numerous occasions is misguided. The influence of historiography on aspects of political thought in France, Italy and Germany. In recent years the overlap between political thought and historiography has changed the boundaries of intellectual history. Donald Kelley, the longtime editor of The Journal of the History of Ideas has played a leading part in this process. These essays by his friends and former students follow in his footsteps. Readers of “lives” of the famous know well the tendency of biography, and especially autobiography, to become steadily less interesting as the subject grows older. A predictable record of challenges met, enemies shafted, honours received and great men encountered often succeeds an account of a childhood that is a highly-coloured and unique emotional drama. Often the best pages are those on the subject’s schooldays, when the personality first tangles with the public realm. As Barry Oakley says of school in a (...) piece quoted in the book’s preface: “Like the stage, it’s an image of life: life accelerated, life concentrated, life more formidable.” The project of selecting just the highlights of all the stories of Australians’ schooldays promises, then, a high payoff if it is well done. It is a high-risk enterprise, though: a pointillist canvas brilliant in each fleck may easily look like mud from a distance. There are well over a hundred authors here, with only three pages or so each to paint a vignette of school. In fact, the result is an enormous success. The editors have a sure eye, and they and their research assistant, Pamela Williams, have put in the work to find the goods. Almost every piece is gripping, and quite different from the others. The total effect is additive, and is an unexampled insight into how the Australia we know came into being. The classics are there: Henry Lawson and Patrick White, Seven Little Australians and The Getting of Wisdom, Donald Horne, Barry Humphries and Clive James. So are the many unknowns whose recollections take us into obscure corners. If there is one overall theme, it is that of sameness, difference and “fitting in”. The effect of the accumulated evidence is rather more subtle than the received ideas on “identity and difference”, multiculturalism and so on. School is where the strangeness of one’s own family, or of one’s own personality, meets the social world – itself perhaps no less weird, objectively speaking, but possessed of resources for ensuring conformity. This work approaches texts in the history of philosophy as the repository of a kind of literature that brings together rational thought and rhetorical principles.

Near the conclusion of the so-called marriage group in the Canterbury Tales sits Chaucer's Squire's Tale, a strange, hybrid narrative of love and betrayal located in the Mongol empire. Surprisingly, however, none of the many modern readers of the tale has made a study of how the Squire's Tale's setting in the East is connected to its view of the subject that dominates Fragments IV and V of the Canterbury Tales: love, power, and the negotiation of a settlement in the (...) prolonged war between the sexes. The omission is especially perplexing when the Squire's Tale is read in combination with its companion narrative, the Franklin's Tale. Indeed, the relation of Squire to Franklin is normally seen as old money to new, aristocrat to parvenu without reference either to the question of female power or to the geographical and cultural oppositions upon which the stories also insist. When the Squire is understood as making a contribution to the conversation initiated by the Wife of Bath and carried on at least through the Franklin's Tale, it is generally on the subject of true nobility, chivalry, or gentillesse—not on the “gentle sex.” Donald Baker even goes so far as to rechristen G. L. Kittredge's marriage group a “gentillesse group” in order to include the Squire in its discussion. (shrink)

In The Untamed God (2003), Jay Wesley Richards defends what he calls “theological essentialism,” which affirms God’s essential perfections but also recognizes contingent properties in God. This idea places Richards’s view in the vicinity of Charles Hartshorne’s dipolar theism. However, Richards argues that Hartshorne’s modal theory suffers from the defects that it abandons the principle ab esse ad posse, makes nonsense of our counter-factual discourse, and can only be expressed by C. I. Lewis’s S4, although for certain purposes Hartshorne needs (...) the stronger S5. Richards, however, fails to realize that Hartshorne’s theory involves two concepts of necessity—necessity as what is common to every possible world-state and necessity as it pertains to the unalterability of the past. While questions remain about Hartshorne’s theory, Richards’s arguments against it are unsuccessful. Most importantly, Richards uncritically accepts the concept of possible worlds as a basis for his critique, but Hartshorne’s arguments cast doubt on the coherence of this idea. Possible worlds provide anything but a firm foundation on which to make sense of either theological essentialism or Hartshorne’s panentheistic dipolar theism. (shrink)

This study blends together ethical philosophy, neurocognitive-evolutionary studies, and literary theory to explore how imaginative discourse addresses a distinctively human deep sociality, and by doing so helps shape cultural and literary history. Deep sociality, arising from an improbable evolutionary history, both entwines and leaves non-reconciled what is felt to be significant for us and what ethical sense seems to call us to acknowledge as significant, independent of ourselves. Ethical Sense and Literary Significance connects literary and cultural history without reducing the (...) literary to a mere expression of something else. It argues that affective differences between non-egocentric and egocentric registers of significance are integral to the bioculturally evolved deep sociality that verbal art addresses-often in unsettling and socially critical ways. Much imaginative discourse, in early societies as well as recent ones, brings ethical sense and literary significance together in ways that reveal their intricate but non-harmonized internal entwinement. Miller** (bio) and Robert D. Truog (bio)Traditionally the cessation of breathing and heart beat has marked the passage from life to death. Shortly after death was determined, the body became a cold corpse, suitable for burial or cremation. Two technological changes (...) in the second half of the twentieth century prompted calls for a new, or at least expanded, definition of death: the development of intensive care medicine, especially the use of mechanical ventilators, and the advent of successful transplantation of vital organs. Patients with profound neurological damage, leaving them incapable of breathing on their own and in an irreversible coma, could be maintained for some period of time with the aid of mechanical ventilation. The situation of these patients posed two ethical questions. Is it appropriate to stop life-sustaining treatment? If so, is it acceptable to retrieve vital organs for transplantation to save the lives of others before stopping treatment?In 1968, the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death proposed that death could be determined on the basis of neurological criteria, thus providing a positive answer to these two questions (Ad Hoc Committee 1968). According to the position of this committee, patients diagnosed with the cessation of brain function are dead, despite the fact that they breathe and circulate blood with the aid of mechanical ventilation. [End Page 185] Because they are dead, it is appropriate, indeed imperative, to stop mechanical ventilation. And because they are dead, it becomes ethical to procure vital organs for transplantation before stopping what otherwise would be life-sustaining treatment. Remarkably, this innovative neurological determination of death became, with little debate or controversy, the established position in medical ethics and the law throughout the United States.The Harvard Committee articulated the diagnosis of “irreversible coma,” but merely asserted that this condition constituted death. No explanatory rationale was provided. It fell to the President’s Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research to provide an authoritative rationale in its 1981 report, Defining Death. The second paragraph of the report set the stage as follows: “The question addressed here is not inherently difficult or complicated. Simply, it is whether the law ought to recognize new means for establishing that the death of a human being has occurred” (President’s Commission 1981, p. 3). The Commission claimed that “death is a unitary phenomenon” (p. 7) and that the determination of death by neurological criteria, in terms of the absence of all brain function, is consistent with the traditional conception of death as the cessation of vital functioning of the organism as a whole. The key issue is the integrative functioning of the human organism, which ceases to exist, according to the Commission, when the whole brain, including higher cortical areas and the brain stem, fails to function. Although “brain-dead” patients do not appear to be dead—i.e., the reality of their death is “masked” by the activity of mechanical ventilation—the patient’s body has irreversibly lost all capacity for integrative functioning. In the words of the Commission: “When artificial means of support mask this loss of integration as measured by the old methods [cessation of respiration and heart beat], brain-oriented criteria and tests provide a new window on the same phenomenon” (p. 33). The President’s Commission was instrumental in developing and establishing “The Uniform Definition of Death Act”: “An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead” (p. 2).Although the question posed by the President’s Commission was easy to articulate, the answer, over time, has proved complicated and controversial. The coherence and cogency of determining death by neurological criteria has been challenged. A predominant ethical view holds that physician‐investigators should conduct their research with therapeutic intent. And since a physician offering a therapy wouldn't prescribe second‐rate treatments, the experimental intervention and the best proven therapy should appear equally effective. "Clinical equipoise" is necessary. But this perspective is flawed. The ethics of research and of therapy are fundamentally different, and clinical equipoise should be abandoned.

The Philosophy of Literature: Four Studies puts forth the question of the extent to which philosophers must go to school with the poets. It begins with a new interpretation of the famous Platonic quarrel with the poetic wisdom of Homer. It brings this question forward through the humanism of thinkers of the Italian Renaissance and the German Idealism of Hegel. It then treats the relation of philosophy and literature in four ways by considering philosophy as literature, philosophy of literature, philosophy (...) in literature, and philosophy and literature. In regard to the first of these, it discusses Jorge Luis Borges’s The Immortal, to the second James Joyce’s Finnegans Wake, to the third Carl Sandburg’s epic prose poem The People, Yes, and to the fourth, Sebastian Brant’s Ship of Fools. This work demonstrates that in an area of thought often dominated by fashionable doctrines of literary interpretation, the great works of literature and philosophy remain as permanent residents of our thought and imagination.
